“Investigators believe the sequence being recorded entailed the use of a prop firearm when it was discharged. “Detectives are looking into how and what type of projectile was used,” the department said.

According to the summary of the postmortem examination into Hutchins’ death, which New Mexico’s chief medical investigator legally signed, “law enforcement reports revealed no convincing evidence that the pistol was purposefully loaded with live ammo.”

Baldwin has denied pressing the trigger and told investigators that the assistant director told him it was a ‘cold gun,’ implying that it was not filled with live shots.

The initial inquiry into Hutchins’ death was led by Santa Fe County Sheriff Adan Mendoza, who described “a degree of carelessness” on the film set.

However, after giving the results of a yearlong inquiry in October, he left decisions regarding potential criminal charges to prosecutors. The report does not say how to live ammo ended up on the scene.

Is Actor Alec Baldwin Arrested? Charges Explored

The armorer who oversaw all weapons used on the set of the Western film “Rust,” as well as Actor Alec Baldwin, will face two counts of involuntary manslaughter in the fatal shooting of cameraman Halyna Hutchins.

By the end of January, the charges will be formally filed in New Mexico’s First Judicial District Court. Each person charged will be expected to appear in court for the first time.

According to the district attorney’s office, Baldwin and Gutierrez-Reed will be “charged in the alternative.” That is, a jury would decide not merely whether they were guilty but also under what concept of involuntary manslaughter they were guilty.

Assistant director David Halls has also agreed to a plea deal for careless use of a deadly weapon. The plea agreement stipulates a suspended sentence and six months of probation.

The second charge is involuntary manslaughter while carrying out a legal act. This charge requires proof of more than ordinary negligence in a death.

This second offense is similarly punished by up to 18 months in prison and a $5,000 fine. This crime carries a firearm enhancement, which implies there is a mandatory additional sentence because a firearm was involved. The enhancement involves a mandatory five-year prison sentence.

Hutchins, a Journalist turned filmmaker, was born in Ukraine as an army brat. She “grew up on a Soviet military installation in the Arctic Circle surrounded by reindeer and nuclear submarines,” according to her website. 

“There wasn’t much to do outside,” she told American Cinematographer, explaining why she was already a movie fan.
